Can Remaining Silent Be Used Against Me?

Question: If I choose to remain silent, can this be used against me in my case?

Answer: That’s a yes and no question. It cannot be used to say you were guilty because you didn’t answer the question. There have been cases where they have said that certain types of observations can be mentioned. So, the officer may be able to have some comment but they can’t comment and use it as a consciousness of guilt.
